TERMS OF DONATING TO THE AUSTRALIAN CAKE ANGELS NETWORK Inc

1. INTRODUCTION

   1. These terms and conditions constitute an agreement between the Volunteer and Cake Angels and are governed by and construed in accordance with the laws of Australia.
   2. Cake Angels reserves the right to modify these terms and conditions at any time. The volunteer will be made aware at the time of any modifications.

2. DEFINITIONS IN THESE TERMS AND CONDITIONS:

   1. Accompanying Document means a document that is given to the recipient with the cake in accordance with clauses 6 and 7.
   2. Prohibited ingredients means any ingredient Cake angels or the parent/guardian of the child notifies the Volunteer of is not to be used in the cake. This includes but is not limited to whipped cream, cream cheese, nuts of all kinds. Decorations or fillings that require refrigeration need to be disclosed to the receiving party.
   3. Cake Angels means The Australian Cake Angels Network Inc. Registrations no. A0058241X, (‘Cake Angels’) a registered charity within the laws of Australia.
   4. Cake means any cake or baked goods for donation to the recipient.
   5. Charity means any organisation recognised as a charity under Australian Law.
   6. Donation means Giving a cake or baked goods without cost to the recipient.
   7. Donation commitment means a commitment by a volunteer to donate on behalf of the Cake Angels.
   8. Recipient means the charity, or the person who has been nominated by a charity, to receive the donation.
   9. Volunteer means the individual or business named as such in the volunteer details section of these terms and conditions.
   10. Third party means anyone other than the recipient.

3. REGISTRATION

   1. By accurately completing their details in the volunteer details section, the volunteer registers as a volunteer and agrees to be bound by these terms and conditions.
   2. Registering as a volunteer with the Cake Angels does not guarantee the volunteer the opportunity to donate. Opportunities to donate are subject to the referrals from the support agencies that work with the Cake Angels and at the Cake Angels discretion.

4. DONATIONS

   1. The Volunteer must inform Cake Angels if they are unable to fulfil a Donation commitment.
   2. The Volunteer will use its best endeavour to give Cake Angels sufficient notice if they are unable to fulfil their scheduled Donation commitment.
   3. The volunteer must not under any circumstances pass on any instruction to another party to fulfil or help fulfil their donation commitment (whether or not this person is registered with Cake angels) without the consent of the cake angels.

5. VOLUNTARY NATURE OF AGREEMENT

   1. A Donation made by the volunteer to the recipient is free and voluntary. The Volunteer is not entitled to any financial reimbursements whatsoever.
   2. The volunteer must not accept financial reimbursement of any form whatsoever for a donation from either the recipient or charity.
   3. In the event the recipient or anyone associated with the recipient offers financial reimbursement volunteers shall advise them to instead donate to the Cake Angels or the charity that referred the recipient.
   4. Under NO circumstances should a volunteer initiate any suggestion that the recipient should donate to the Cake angels or any other charity.
   5. Except as is provided under clause 5.f, any additional item to be presented as a donation (for example balloons, cake toppers, decorations, toys or any type of promotional material, etc) will be at the Volunteers own expense and initiative. Any request for such additional items is not to be associated or implied to be associated with The Cake Angels.
   6. Cake Angels may occasionally be presented with a donation that can be used on cakes. The volunteer can request these to be used on Cakes where appropriate, however these items are subject to availability and Cake Angels reserves the right to decide who will receive any additional items.
   7. Under no circumstances should the Volunteer claim or imply to any third parties that they are representing the Cake Angels in any capacity, unless they have received specific written approval from the Cake Angels to ACT on its behalf.

6. INGREDIENTS

   1. The volunteer must not use a prohibited ingredient in a cake.
   2. The volunteer must be able to provide a list of all ingredients used in the cake if and when requested by the recipient or the Cake Angels.
   3. The Volunteer must provide refrigeration requirements, storage and or cake care instructions to the recipient.
   4. Any non-edible structural equipment such as wires, straws, dowels, support sticks etc, need to be disclosed to the recipient.
   5. No fresh cream or cream cheese is to be used. No nuts of any type to be used in any cake or baked good, including cookies, cupcakes, slices etc. Ingredients stating may contain traces of nuts may be used but if the recipient has a nut allergy this must be disclosed to the recipient.

7. WARRANTY

   1. The Volunteer warrants it will list all ingredients used in the cake on the packaging of the cake or an accompanying document if required by the recipient.
   2. The Volunteer warrants it will not use any prohibited ingredients in the cake.

8. LIABILITY AND INDEMNITY

   1. The Volunteer is personally responsible for any donation and Cake Angels accepts NO liability for any claims, losses, expenses, damages, costs or injuries arising directly or indirectly out of, or connected with, the donation commitment or the agreement arising under these terms and conditions.
   2. The Volunteer agrees to indemnify Cake Angels an any of its associated parties from all claims, losses, expenses, damages, costs, and injuries arising directly or indirectly out of, or connected with, the donation commitment or the agreement arising under these terms and conditions.

9. PUBLICITY

   1. Cake Angels reserves the right to decide on usage of any photographs of any cakes sent to them by the volunteer or the recipient and the Volunteer:
      1. Consents to such usage; and
      2. Will obtain all necessary approvals for such
   2. There is no guarantee that any photos of a cake sent to Cake Angels will be used on any Cake Angels website or social media platforms.
   3. Photos containing images of the child recipient may be published by cake angels and the volunteer providing parental consent has been obtained. Cake Angels holds no responsibility if a volunteer or anyone else publishes a photo of recipients without written consent or permission to do so.

10. PRIVACY

    1. All information collected in Cake Angels Volunteer registration process is in accordance with the National privacy principles established under the Privacy Act 1988 dealing with the collection, use and storage of personal information about individuals.
    2. The information provided by the volunteer during the registration process will only be used for the purpose of providing services for which the Cake Angels is set up to provide.
    3. The personal details of the volunteer will only be passed onto a participating charity with the consent of the volunteer.
    4. The Volunteer must provide up to date information and inform cake angels of any changes in their registration details including but not limited to their phone number, address, email and kitchen registration.
    5. The Volunteer may alter their privacy preferences at any stage after registration by emailing Cake Angels at registration@cakeangels.org.au.

    8. The Volunteer may not at any time disclose or use in anyway any personal information provided by the Cake Angels or the recipient during the process of a donation commitment and agrees to keep all personal information confidential.

11. COVID-19 POLICY

    In the best interest of Cake Angels committee, Volunteers Children, their families and our referral agencies the Cake Angels have established a COVID-19 policy, which sets out the rules and procedures our not-for-profit will implement for the duration of the COVID-19 crisis.

    1. If you have been assigned to make a cake for a child and the State in which you live in is currently in a lockdown - that cake cannot be made under the Cake Angels banner, we will postpone all cakes till such a time when the lockdown in that state has either eased restrictions or completely lifted them. This is to protect not only our volunteers but also the child receiving the cake and their family.
       
       We understand this is a difficult time for these families and that they may still opt to receive their cake, in this case If you do choose to make the cake for the child it will be at an agreement between both you and the family. The cake angels will have no responsibility for any adverse outcomes, we are also not able to share pictures of your cake in this circumstance.
    2. If you are delivering a cake to a child, you must if required wear a mask and follow all health advice as per your State government. Non-contact deliveries are best during these uncertain times.
